Love Contracts

Mark Toth at the Manpower Employment Blawg has a follow-up post today here on his Valentine’s Day survey regarding love contracts.  Apparently the results were evenly mixed — 50% in favor, 50% against.  We had a post discussing this issue back on Valentine’s Day here.  As suggested by my quote in Mark’s post, I fall on the “against” side of the fence.

    Hello Eric!

    Thanks for your participation in our lively love contract discussion. It was interesting to see that all the lawyers who commented were staunchly opposed to love contracts but the poll showed an even 50-50 split among our voters. Looks like HR folks may be more in favor of ‘em than us legal types.

    Thanks for the comment! There is an important insight in your comment about the different perspective of lawyers vs. human resources professionals. The focus of HR is on the people in the organization. HR professionals may view “love contracts” as another way to keep their people engaged and productive. Attorneys, particularly outside counsel, need to remember this when they are advising a corporation (as you pointed out in your video the other day, the corporation is the client–

    Part of good counsel is balancing all of the competing interests at play in a particular situation, not merely the law.
